Legal · Terms of service

The deal, in plain words.

These terms are the agreement between your agency and us when you use Akij Air OTA: the storefront we run for you, the portal you manage it from and the plan you pay for. By creating an account or using the service you accept them.

01

Who we are and definitions

Akij Air OTA is operated by Akij Air (Akij Air), AKIJ HOUSE, 198 Bir Uttam Mir Shawkat Sarak, Tejgaon, Dhaka-1212. Akij Air is the travel business of AKIJ Resources Limited. A few words carry a precise meaning in these terms:

We, us, Akij Air
The operator of the platform, named below.
You, the client
The travel business that opened the account, and the people it lets use it.
Storefront
The white-label travel site we run for you: the consumer site, the agent portal and its admin, on your domain.
Portal
Your account with us at akijairota.com, where you manage plans, invoices, domains and tickets.
Plan
The package you subscribe to: a price per month or per year, a setup fee where one applies, and the limits and features that come with it.
Your customers
The travellers and agents who use your storefront. They are your customers, not ours.

Eligibility and accounts

An account is opened by a person on behalf of a travel business. Four things we ask of you.

  • Business use

The platform is for travel businesses. You confirm you are opening the account on behalf of one and may bind it to these terms.

  • Accurate details

Give us your real business name, contact details and address, and keep them current. We rely on them for invoices and notices.

  • Credentials and 2FA

Keep passwords and authenticator codes to yourself. Every account has two-step sign-in; what happens under your sign-in is on you until you tell us it was compromised.

  • Your team

You can invite colleagues to your portal and staff to your storefront's admin. You are responsible for who you let in and for removing people who leave.

Tell us straight away if you believe someone else has your credentials. We can sign every device out of your account from our side.

03

The service

What you get, in the shape the product actually has.

  • Storefront and admin

A themed consumer site and B2B agent portal for your travellers and agents, and an admin where you run bookings, markups, content and your team.

  • Plans and limits

Each plan carries limits and features (sites, users, modules). They are snapshotted when your subscription starts and apply until you change plan.

  • Free trial

A plan may start with a free trial. No card is needed; nothing is billed until the trial ends and you continue on a paid plan.

  • Provisioning and domains

We provision your storefront when a subscription starts and serve it on a subdomain of ours or on a custom domain you own. You control that domain's DNS; we issue its certificate once it points at us.

Features that your plan does not include, or that we switch off for your storefront at your request, are not part of the service for you. The current plans are on the pricing page.

04

Your responsibilities

You run a travel business on the platform; we run the platform. That split puts a few things squarely on your side.

  1. 1

    Your customers and their data

You decide what you collect from travellers and agents and why; you handle their requests, refunds and complaints. We process their data on your behalf (see Data protection).

  2. 2

    Travel licences

Selling travel is regulated. Any licence or accreditation your business needs (IATA, ATAB, a tour-operator registration and the like, where they apply to you) is yours to hold and keep valid.

  3. 3

    Content and fares

The prices, markups, texts, images and offers on your storefront are published by you. Make sure they are accurate, lawful and yours to use.

  4. 4

    Lawful use

Use the platform in line with the laws that apply to you and to your customers, including consumer, tax and data-protection rules.

  5. 5

    No reselling of the platform

Your storefront is for your own travel business. Do not resell, sublicense or white-label the platform itself to other businesses without a written agreement with us.

05

Fees, billing and taxes

You pay the price of your plan for each billing period, plus a one-off setup fee where the plan has one. Quoted prices exclude VAT unless marked otherwise; VAT is added to the invoice at the rate our tax settings require, and the rate and our BIN are printed on it.

  • Cycles and the first bill

Plans are billed monthly or yearly, in advance. The first invoice is raised when a paid subscription starts; a trial raises nothing until it converts.

  • Renewals and reminders

We raise the next period's invoice a number of days before the current period ends and email it to you. An unpaid invoice past its due date is overdue and we remind you at intervals.

  • Grace period and suspension

If a period ends unpaid, your subscription is past due. After a grace period of seven days the storefront is suspended: it stops serving your customers until the invoice is paid.

  • Reactivation

A confirmed payment reactivates a suspended storefront. Your data stays in place while it is suspended.

  • Coupons

A coupon code entered at checkout is taken off the first invoice (price and setup fee). One redemption per subscription; we may withdraw a code that was shared beyond its purpose.

  • Plan changes and credit notes

When you change plan, the unpaid days of your paid period are credited against the new plan's first invoice. Any remainder becomes a credit note, applied to your next bill or refunded on request.

Every invoice shows its due date and the ways to pay it. The setup fee is billed once, on the first invoice, and is not refunded once provisioning has started. We may change a plan’s price for future periods with at least thirty days’ notice by email; the price of a period already invoiced does not change.

06

Payments

  • Bank transfer, bKash, Nagad

Pay to the account shown on the invoice and report the payment from your portal with the reference and, if you like, a receipt. Our team matches it to the invoice and confirms it; until then it shows as pending.

  • Online through SSLCommerz

Cards, internet banking and mobile wallets through SSLCommerz, a payment gateway licensed in Bangladesh. The payment is confirmed to us by the gateway and lands on the invoice at once.

  • No card data with us

Card details are entered on the gateway's pages, never on ours. We store the gateway's reference and the amount, nothing more.

A payment counts as made when we confirm it, not when you send it. Report a transfer as soon as you make it so the match is quick; a payment that reaches us for more than the balance stays on your account against the next invoice.

07

Refunds

Subscription fees pay for a period in advance and are not refunded once that period has started, with a short list of exceptions: a duplicate payment, a charge after a confirmed cancellation, a billing mistake on our side, or prolonged unavailability that we caused. Trials cost nothing. Unused days on a plan change become a credit note.

Suspension and termination

By you

  • Cancel from your portal at any time; the subscription runs to the end of the period you paid for and does not renew.
  • Open invoices stay payable for the service already provided.
  • For thirty days after termination you can ask us for an export of your storefront's data (bookings, customers, content). After that window the tenancy is deleted.

By us

We can suspend or end the service for three reasons only:

  • Non-payment, after the grace period and the reminders described above.
  • A material breach of these terms or the acceptable-use rules that is not fixed within fourteen days of our notice, or at once if it cannot be fixed or puts other clients at risk.
  • A legal requirement, a court order or an instruction from a competent authority.

A suspended storefront keeps its data and comes back when the cause is resolved. When the agreement ends, the clauses on fees owed, intellectual property, liability, indemnity and governing law continue to apply.

09

Data protection

Two kinds of personal data pass through the platform, and the roles differ. For your own account data (your contacts, invoices, sign-ins) we are the controller and our privacy policy explains what we do. For your customers’ data, you are the controller and we process it on your instructions, only to run and support your storefront.

What we promise

Each storefront’s data is kept in its own tenancy, staff access is logged, we never sell it, and we delete it after the export window when you leave.

What we ask

Publish a privacy notice for your customers, collect only what you need, and route their data requests to us when you need our help to answer them.

10

Intellectual property and licence

The platform is ours. The software, designs, themes, documentation and the Akij Air OTA name stay the property of Akij Air and its licensors. For as long as your subscription runs you have a non-exclusive, non-transferable licence to use the service for your own travel business.

Your content is yours. Your logo, texts, images, fares and customer data remain yours. You give us the licence we need to host, display and back them up to run your storefront, and nothing more.

Feedback you send us about the product may be used to improve it, without payment or credit, and does not give you rights in what we build.

11

Acceptable use

The platform is shared by many agencies. These rules keep it safe for all of them.

  • No unlawful, fraudulent or misleading offers, including fares or availability you cannot honour.
  • No malware, scraping of other clients' storefronts, or attempts to reach another tenant's data.
  • No load testing, penetration testing or security probing without our written consent.
  • No sending of spam from your storefront's mail and SMS channels.
  • No content that infringes someone's rights or that is defamatory, hateful or obscene.
  • No circumvention of plan limits, coupons or billing.

If we see a breach we will tell you and, where it endangers other clients or their customers, suspend the storefront while it is sorted out.

12

Availability, support and changes

  • Status page

Incidents, maintenance and what changed are published on the status page and, when it matters to you, by email.

  • Support

Open a ticket from your portal or email us. Support hours are Daily, 09:00 AM – 02:00 AM; we aim to answer within one working day.

  • Maintenance and changes

We improve the platform continuously and schedule planned maintenance outside peak hours where we can, with notice on the status page. We may retire a feature with reasonable notice.

We aim to keep the service available around the clock, but we do not promise it will be uninterrupted or error-free. Prolonged unavailability that we caused is a ground for a refund under the refund policy.

13

Warranties and liability

The service is provided as is, with the care of a competent provider, and without other warranties to the extent the law allows us to exclude them. Our total liability to you for everything arising out of these terms in any twelve-month period is capped at the fees you paid us in the twelve months before the event that gave rise to the claim.

We are not liable for:

  • Loss of profit, revenue, bookings, goodwill or data, and any indirect or consequential loss.
  • The outcome of a booking: an airline's or supplier's schedule change, cancellation, refund decision, overbooking or service. We provide the shop, not the flight.
  • Downtime or faults caused by your DNS, your domain registrar, your integrations, your devices or your staff.
  • Anything caused by a breach of these terms on your side.

Nothing here limits a liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

14

Indemnity

If a third party brings a claim against us because of the content you published, the travel you sold, your breach of these terms or of a law that applies to your business, you will cover the losses, costs and reasonable legal fees we incur. We will tell you about such a claim promptly and let you take part in its defence.

15

Changes to these terms

We may update these terms as the product and the law change. For a change that matters to you we send an email to your account’s primary contact at least fourteen days before it takes effect; small clarifications take effect when published. If you keep using the service after the date, you accept the new terms. If you do not, cancel before it and the old terms apply to the end of your period. The date at the top is the version you are reading, and the version you accepted is recorded on your account.

16

Governing law

These terms are governed by the laws of the People’s Republic of Bangladesh. If we disagree about something, we first try to settle it in good faith: write to us, and a person with authority on each side talks within fourteen days. What cannot be settled that way goes to the competent courts of Dhaka, which have exclusive jurisdiction.
